Maker
As with an Arbitrator, a Decision Maker
can only be appointed by agreement of the parties and as with a
Parenting Coordinator, a two year appointment is made. A Decision
Maker can make decisions now, subject to later court review. A
Decision Maker is very helpful in situations where there is high
conflict, especially over parenting time or a parenting plan and related
issues, and with an expectation that over the two year appointment the
conflict will subside and the parties will be able to make their own
decisions, hopefully based on the example set by the Decision
Maker. The biggest advantage to a Decision Maker is the speed with
which decisions can be made. Another advantage is that the
Decision Maker has direct personal contact with the parents and gains a
familiarity with the family quickly. The costs of having a
Decision Maker are generally a small fraction fo what it would cost to
litigate the same issue(s) in Court.
